Terms and Conditions

Inka Media provides technological infrastructure for multimedia content playback, which may include, among others: multimedia players, integration tools, APIs and SDKs, display and playback control functions. Inka Media does not host, transmit, store, or manage audiovisual content, nor does it select, modify, or supervise the content that the User accesses through the Services. All content played through the Services comes from external sources and is the sole responsibility of the User and/or the corresponding third-party provider.

The User declares that they are at least 18 years of age and have legal capacity to enter into this Agreement. The User agrees to use the Services only for lawful purposes and in accordance with applicable legislation in their jurisdiction. Inka Media does not guarantee that the Services will be available uninterruptedly or free of errors, and reserves the right to modify or discontinue them at any time.

The Services allow playback of multimedia content provided by third parties, including, among others, external servers, streaming platforms, APIs, or links provided by the User themselves. Inka Media: is not the owner of the content, has no editorial control over it, does not verify its legality, accuracy, or licensing, cannot remove, modify, or disable external content. Any claims related to copyrights, licenses, legality, or availability of the content must be directed exclusively to the content provider or the User who supplied it.

Some Inka Media Services may be subject to subscription fees or recurring charges. The specific conditions of each subscription, including prices, duration, and features, will be communicated to the User before contracting. Unless applicable law provides otherwise, all payments are final and non-refundable. Inka Media reserves the right to modify prices or plans with future effect.

Personal information provided by the User is governed by Inka Media's Privacy Policy. The User is responsible for maintaining the confidentiality of their access credentials and for any activity conducted from their account.

Inka Media grants the User a limited, personal, non-exclusive, non-transferable, and revocable license to use the Services in accordance with this Agreement. The User may not copy, modify, distribute, decompile, reverse engineer, or commercially exploit the Services without the express written authorization of Inka Media.

All intellectual property rights related to the Services, including software, trademarks, interfaces, designs, and documentation, are the exclusive property of Inka Media LLC or its licensors. This Agreement does not grant the User any ownership rights over the Services.

The User agrees to indemnify and hold harmless Inka Media LLC, its affiliates, directors, employees, and collaborators against any claims, damages, losses, or expenses arising from: the use of the Services, access to or playback of third-party content, violation of copyrights or other third-party rights, breach of applicable laws. This obligation shall survive the termination of the Agreement.

The Services are provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, Inka Media shall not be liable for: the legality or licensing of reproduced content, service interruptions, damages arising from the use of third-party content, indirect, incidental, or consequential losses. Inka Media's total liability shall not exceed the amount actually paid by the User during the three (3) months preceding the event giving rise to the claim.

The Services may interact with third-party platforms or services. Inka Media does not control and assumes no responsibility for such services. The use of third-party services is governed by their own terms and policies.

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law rules. Any dispute shall be resolved through binding arbitration in the County of New York, in accordance with the rules of the American Arbitration Association (AAA).

This Agreement and the Privacy Policy constitute the entire agreement between the User and Inka Media. If any provision is deemed invalid, the remaining provisions shall remain in full force and effect. Failure to exercise any right shall not constitute a waiver thereof.
