Terms and Conditions

The User Agreement governs Your access to the Services and any feature, brand, data, message, text, image, photographs, graphics, audio, sound, voice, codes, computer programs, software, database, service information, any form of content (series, movies, sports, games, etc.), as well as interactive elements/features, etc.

The service is offered and available only to users over 18 years of age. By accessing and using the Services, you agree to the Age Suitability Terms. You may use YouTube API/SDK services or any third-party API/SDK services in some of our products as permitted by YouTube's policies or such third-party terms.

You should only access and use the Services if you can form a binding contract with Inka Video Player and are not prohibited from receiving services under Singapore law or other applicable jurisdiction.

The services offered to you are always evolving and the form and nature of the services may change from time to time without prior notice.

Content will be made available to you through different modes at Inka Video Player's discretion, including on-demand video and download for offline viewing.

Availability and your ability to access Content or any part of the Services may depend on Your geographic location.

Part of the premium category content labeled as 'MX One' can only be accessed by Users who have opted for any of the specific subscription plans. We may offer different types of subscription plans (monthly, quarterly, semi-annually, annually) with different limitations and restrictions. No free trial period will be provided unless MX offers it at its sole discretion. To become a subscription user, you will be required to create an account containing information such as your Apple account and/or Facebook, and mobile phone number. After successful account creation, you will be required to pay a subscription fee to access the Service.

The specified subscription fee for each subscription plan includes applicable taxes. You will be required to pay the subscription fee through in-app purchases in the Apple store. The chosen subscription packages will be applicable for a specific period ('Subscription Term') which can be monthly, quarterly, or annually. We reserve the right to change, cancel, or amend subscription packages and/or Subscription Fees and/or billing cycles at any time.

The Subscription Fee will be billed according to Your selected Payment Method at the start of Your Subscription Term and on each subsequent renewal automatically unless and until you cancel the Service. You are responsible for the accuracy and authenticity of the information provided, including bank account/credit card details. All payments made under the User Agreement are non-refundable, and we do not provide refunds or credits for any partial-month subscription periods for any reason.

The information you provide to Inka Video Player is subject to our Privacy Policy, which governs our collection and use of Your information.

You are responsible for protecting the password or credentials you use to access the Services and for any activity or action on Your Inka Video Player account. We recommend that you use secure passwords (passwords that use a combination of uppercase and lowercase letters, numbers, and symbols) with Your account and with other accounts you may connect to Your Inka Video Player account (such as Your social media accounts or Your email). Inka Video Player cannot and will not be liable for any loss or damage arising from Your failure to comply with the above requirements.

Inka Video Player grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the Service provided to you by Inka Video Player as part of the Services. This license is solely for the purpose of enabling you to use and enjoy the benefit of the Services provided by Inka Video Player, in the manner permitted by the User Agreement. Save and except for accessing and using the Services as permitted herein, you shall not use any part of the Services (such as codes, features, trademarks/trade names/logos, look and feel, content, etc.) separately without express written approval from Inka Video Player.

For the purposes of this User Agreement, the term 'Intellectual Property Rights' shall mean all patents, trademarks, service marks, copyrights, database rights, trade names, brand names, trade secrets, design rights, and similar proprietary rights of Inka Video Player and/or its licensors and/or other respective owners, whether registered or unregistered and all renewals and extensions thereof.

Artist profiles, illustrations, jokes, memes, contests, game elements/content, interactive elements, and all other elements, data, information, and any other content/material are the property of Inka Video Player and/or its licensors and/or other respective owners and are protected, without limitation, under the relevant intellectual property laws of Singapore and the world. Inka Video Player retains total, complete, and absolute title to the Service and all Intellectual Property Rights therein.

Inka Video Player reserves the right at all times (but shall have no obligation) to remove or withdraw any Content (including Service Content and Third-Party Content) on the Services and to suspend or terminate User(s), and claim profile URLs. without liability to you. Inka Video Player also reserves the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process, or governmental request, (ii) enforce the User Agreement, including investigation of potential violations thereof, (iii) detect, prevent, or otherwise address fraud, security, or technical issues, (iv) respond to user support requests, or (v) protect the rights, property, or safety of Inka Video Player, its users, and the public.

You agree to indemnify, defend, and hold harmless Inka Video Player and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these User Agreement, any activity related to Your account by You or any other person accessing the Services using Your account, or any other violation of the rights of any third party by You.

Inka Video Player respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that any Content has been copied in a way that constitutes copyright infringement, please provide the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that should be removed or access to which should be disabled, and reasonably sufficient information to permit us to locate the material; (iv) your contact information and an email address; (v) a statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

You have read this section carefully as it limits the liability of Inka Video Player and its parent companies, subsidiaries, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors (collectively, 'Inka Video Player Entities'). Each of the subsections below applies only to the maximum extent permitted by applicable law. Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability in contracts and, as a result, the contents of this section may not apply to you. Nothing in this section is intended to limit rights that may not be legally limited.

This User Agreement shall be governed by and construed in accordance with the laws of the State of New York, excluding its conflict of law rules. Any controversy, claim, or dispute arising out of or relating to this User Agreement shall be exclusively resolved by binding arbitration in New York County, in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration award shall be final and binding on both parties, and may be entered in any court of competent jurisdiction as a judgment or order. In addition to arbitration, the parties may seek any interim or preliminary relief from a court of competent jurisdiction necessary to protect their rights or property pending the completion of arbitration.
